She asserts that Combs, alongside Harve Pierre and another individual whose identity remains undisclosed, sexually assaulted her. According to her claims, the incident occurred after she was transported to New York via a private jet and administered drugs and alcohol, rendering her unable to provide consent.
Sean’s defense team has refuted these claims, arguing that the lawsuit lacks credibility and that the alleged incident, which dates back nearly two decades, cannot be substantiated. They have also raised concerns about the timing of the lawsuit, stating that it was brought forward too late under New York law.The legal battle surrounding Combs is part of a broader wave of lawsuits brought under New York’s Adult Survivors Act, which temporarily suspended certain legal deadlines to allow sexual assault survivors to file abuse claims that occurred years or even decades ago. While the deadlines established by this law have expired, the lawsuit against Combs was brought under a different law, New York City’s Victims of Gender-Motivated Violence Protection Law, which allows accusers to file civil complaints involving sexual assault claims after the statute of limitations has expired.
However, his legal team argues that the lawsuit should still be dismissed as it was filed after the deadline mandated by New York state law. They assert that state law supersedes city law in this matter, and therefore, the lawsuit should have been filed by August 2021 to be considered timely.
The judge overseeing the case has ruled that the woman behind the lawsuit will need to reveal her name if the case progresses after this legal challenge. While the woman’s identity has not been disclosed in court filings, Combs’ legal team contends that transparency is essential in adjudicating the matter fairly.
This latest legal development comes amidst a series of lawsuits and investigations involving Combs, including allegations brought forward by other individuals, such as singer Cassie, and a recent sex-trafficking investigation by Homeland Security Investigations. Despite the legal scrutiny, Combs has not been charged with any crimes.
